What is Administrative Review (Administrative Review Against The Home Office UKVI Refusal)

Administrative Review is a way to challenge the Home Office/Entry Clearance Officer’s decision, if your visa is refused either within the country by the Home Office or out of the country by the Entry Clearance Office then you can avail yourself the right to challenge it by way of administrative review.

During the administrative review, you cannot submit new evidence as it differs from appealing the decision.

Administrative Review and Home Office/Entry Clearance Officer

Administrative review is submitted to the Home Office/Entry Clearance Officer and it must be filed online. The outcome of the administrative review will be served on you within 28 days.

Administrative Review from Inside the UK

If your visa is refused with the grant of the Right of Appeal, you can then seek the facility to challenge it by way of administrative review. You should apply for administrative review within 14 days of receiving the refusal notice, however, if you are detained then you must apply within 7 days. The fee to apply for administrative review is £80.00

You can only apply for an administrative review for eligible decisions.

If the home office official maintains the decision then you can still apply for pre-action protocol and then lodge a Judicial Review application to the Upper Tribunal.
